Terms of Service — BenchSpy

Welcome to BenchSpy. These Terms of Service ("Terms") govern your access to and use of benchspy.com and the BenchSpy platform (the "Service"). By creating an account or using the Service you agree to be bound by these Terms.

1. Company

The Service is operated by Tecnologias Online Lda, a company registered in Portugal. Contact email: andre@tecnologiasonline.pt.

2. The Service

BenchSpy is an AI-powered competitor analysis tool. You paste a URL, we scrape the public website, run the Google PageSpeed Insights API, detect the tech stack, and send structured data to Anthropic's Claude model to produce a written competitive intelligence report. Reports are stored in your account dashboard.

2.1 Free tier

Free accounts include up to 3 competitor analyses. Analyses of the user's own declared website are unlimited even on the free tier. We reserve the right to change these limits with notice.

2.2 Paid tiers

Paid tiers (Pro €9/month, Business €29/month, Enterprise €99/month) unlock additional features as described on the pricing page. Billing is handled by Stripe.

3. Subscription & billing

Subscriptions are billed monthly in advance in EUR via Stripe.
You may cancel at any time; access continues until the end of the current billing period.
No refunds are issued for partial months already billed.
If payment fails the account is downgraded to Free tier after a grace period.
Price changes are communicated at least 14 days in advance and never apply retroactively.

4. Acceptable use

You agree NOT to use BenchSpy to:

Scrape personal data or any data protected by privacy laws (GDPR, CCPA, etc).
Abuse the Service via automation beyond reasonable human use.
Resell reports as-is under another brand without a Business or Enterprise license.
Attempt to reverse-engineer, decompile, or otherwise extract the internal logic of the Service.
Bypass quota or anti-abuse mechanisms.
Upload or submit URLs that violate the terms of the target websites where such targeting is illegal.

Violation may result in immediate suspension without refund.

5. AI output disclaimer

The reports generated by BenchSpy use large language models (Claude by Anthropic) and are provided for informational purposes only. Outputs may contain errors, inaccuracies, or hallucinations. BenchSpy does not guarantee the accuracy, completeness, or reliability of any analysis. You are responsible for verifying any conclusions before acting on them.

6. Intellectual property

BenchSpy, the platform, the brand, the source code, the UI, and the underlying methodology remain the exclusive property of Tecnologias Online Lda. You retain ownership of the data you submit (URLs) and the reports you generate, subject to the AI output disclaimer above.

7. Limitation of liability

To the maximum extent permitted by applicable law, Tecnologias Online Lda shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total cumulative liability is limited to the amount you paid in the last month of your subscription, or €9 in the case of Free-tier users.

8. Governing law

These Terms are governed by the laws of Portugal and applicable European Union regulations. Any dispute will be subject to the jurisdiction of Portuguese courts.

9. GDPR

BenchSpy complies with the EU General Data Protection Regulation. For data handling details see our Privacy Policy. To exercise your GDPR rights, email andre@tecnologiasonline.pt.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email and/or a prominent notice on the site. Continued use of the Service after such notice constitutes acceptance.
